Introduction

Welcome to State of Stride. These Terms of Service ("Terms") govern your use of stateofstride.com (the "Website") and the State of Stride mobile application (the "App"), collectively referred to as the "Services."

By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

State of Stride is operated by State of Stride LLC, a company registered in Oregon.

1. Acceptance of Terms

1.1 Agreement to Terms

By accessing or using our Services, you confirm that:

  • You are at least 13 years of age
  • You have read, understood, and agree to these Terms
  • You have read and understood our Privacy Policy
  • If you are between 13-17 years old, you have parental or guardian consent

1.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Services after changes take effect constitutes acceptance of the new Terms.

2. Account Registration and Eligibility

2.1 Account Creation

To use certain features of our Services, you must create an account by providing:

  • A valid email address
  • A secure password
  • Basic profile information (name, age, physical metrics)

2.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

We are not liable for losses caused by unauthorized use of your account.

2.3 Account Eligibility

You may not create an account if:

  • You are under 13 years of age
  • You have been previously banned from our Services
  • You are prohibited by law from using our Services

2.4 One Account Per User

Each user may maintain only one active account. Creating multiple accounts may result in termination of all accounts.

3. Services Description

3.1 Mobile App Services

The State of Stride mobile app provides:

  • GPS-based run tracking with route mapping
  • Treadmill mode for indoor workouts
  • AI-generated personalized training plans
  • Run history and personal records tracking
  • Private run reflections with photo uploads
  • Milestone achievements and progress tracking
  • Browse shop products (checkout via website)

3.2 Website Services

The State of Stride website provides:

  • Account management and profile settings
  • Run history viewing and analysis
  • Training plan management
  • Shop for performance running apparel and accessories
  • Customer support and information

3.3 Service Availability

We strive to provide uninterrupted access to our Services, but we do not guarantee:

  • Continuous, error-free, or secure access
  • That defects will be corrected immediately
  • That the Services are free from viruses or harmful components

We may modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

4. Subscriptions and Payments

4.1 Free and Premium Tiers

Core run tracking and training features are available at no cost. State of Stride also offers a premium subscription tier that unlocks additional features, including AI-generated personalized training plans. Pricing is displayed in the app at the time of purchase.

4.2 Premium Subscriptions

Premium subscriptions are offered under the following terms:

  • Pricing and features are clearly displayed in the app prior to purchase
  • Subscriptions are offered through the Apple App Store and Google Play Store
  • Subscription terms (monthly, annual) are specified at the time of purchase
  • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date
  • You may cancel anytime through your device's subscription settings (App Store or Google Play account management)
  • Subscription management for Apple users: Settings → [Your Name] → Subscriptions
  • Subscription management for Google Play users: Play Store → Profile → Payments & Subscriptions → Subscriptions

4.3 Shop Purchases (Physical Goods)

When purchasing apparel or accessories:

  • All prices are in U.S. dollars (USD)
  • Payment is processed securely via Stripe
  • Shipping costs and estimated delivery times are displayed at checkout
  • All sales are final (see Section 5 for return policy)

4.4 Member Discounts

Active subscribers receive 30% off shop purchases. Discount eligibility is automatically applied at checkout based on account status.

4.5 Refunds

Digital Services: All subscription fees are non-refundable, except where required by law. You may cancel future renewals at any time.

Physical Goods: See Section 5 for return and refund policy.

5. Shop Terms (Physical Goods)

5.1 Product Availability

  • Products are subject to availability
  • We reserve the right to limit quantities or discontinue products
  • Product images are for illustration purposes and may differ slightly from actual items

5.2 Order Processing

  • Orders are processed within 1-2 business days
  • You will receive order confirmation via email
  • We are not responsible for delays caused by shipping carriers

5.3 Returns and Refunds

  • Return Window: 30 days from delivery date
  • Condition: Items must be unworn, unwashed, and in original condition with tags attached
  • Process: Contact team@stateofstride.com to initiate a return
  • Refund Method: Original payment method
  • Shipping: Customer responsible for return shipping costs unless item is defective

5.4 Damaged or Defective Items

If you receive a damaged or defective item:

  • Contact us within 7 days of delivery
  • Provide photos of the damage
  • We will provide a prepaid return label
  • Choose replacement or full refund

6. User Content and Conduct

6.1 Your Content

You retain ownership of all content you create using our Services, including:

  • Run reflections and journal entries
  • Photos you upload
  • Training goals and preferences

By using our Services, you grant us a limited license to store, display, and process your content solely to provide the Services to you.

6.2 Content Standards

While State of Stride is a private journal (not a social platform), you agree not to upload content that:

  • Is illegal, harmful, threatening, or abusive
  • Infringes on others' intellectual property rights
  • Contains malware or malicious code
  • Violates any applicable law or regulation

6.3 Data Export

You may export your data (run history, reflections, photos) at any time via your account settings.

6.4 Content Deletion

  • You may delete individual runs, reflections, or photos at any time
  • Deleted content is permanently removed within 30 days
  • We cannot recover deleted content

6.5 Prohibited Conduct

You may not:

  • Use our Services for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services
  • Use automated scripts or bots to access the Services
  • Share your account credentials with others
  • Engage in fraudulent activities or misrepresent yourself
  • Reverse engineer or attempt to extract source code
  • Use the Services to harm, harass, or impersonate others

Violation of these prohibitions may result in immediate account termination.

7. Intellectual Property

7.1 Our Proprietary Rights

State of Stride and all related trademarks, logos, designs, and content (excluding user content) are owned by us or our licensors. You may not use our intellectual property without written permission.

The Services, including all software, algorithms, and training plan generation systems, are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to:

  • Access and use the mobile app on your personal device
  • Access and use the website for personal, non-commercial purposes

This license does not include the right to:

  • Resell or commercially exploit the Services
  • Copy, modify, or create derivative works
  • Decompile or reverse engineer any part of the Services

7.3 Feedback

If you provide suggestions, ideas, or feedback about our Services, we may use that feedback without any obligation to compensate you.

8. Third-Party Services and Links

8.1 Third-Party Integrations

Our Services may integrate with third-party services (e.g., Apple Health, Google Fit—planned features). Your use of these services is governed by their respective terms of service and privacy policies.

8.2 External Links

Our Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these external sites.

8.3 Payment Processing

In-app subscription payments are processed by Apple (App Store) and Google (Google Play Store), governed by their respective terms. Payment processing for any future web-based purchases (planned) will be handled by Stripe and governed by Stripe's terms.

9. Location Services (Mobile App)

9.1 GPS Tracking

The mobile app uses GPS to track your runs, including:

  • Real-time location during active run sessions
  • Route mapping and elevation data
  • Distance and pace calculations

9.2 Location Permissions

  • You must grant location permissions to use GPS tracking features
  • Location data is only collected during active run sessions
  • You can revoke location permissions in your device settings at any time
  • Treadmill mode allows you to track runs without GPS

9.3 Location Accuracy

GPS accuracy depends on:

  • Device capabilities
  • Environmental conditions (buildings, trees, weather)
  • Satellite availability

We do not guarantee perfect location accuracy and are not liable for inaccuracies in GPS data.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Security or freedom from viruses

Health and Fitness Disclaimer:

  • State of Stride is not a medical device or health service
  • Training plans are for informational purposes only
  • Always consult a healthcare provider before starting any exercise program
  • We are not liable for any injuries or health issues resulting from your use of our Services
  • Listen to your body and exercise responsibly

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

11.1 No Liability for Damages

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including:

  • Loss of profits, data, or use
  • Personal injury or property damage
  • Cost of substitute services
  • Errors in GPS tracking or training plans

11.2 Maximum Liability

Our total liability to you for all claims arising from your use of the Services shall not exceed the greater of: $100 USD, or the amount you paid us in the 12 months preceding the claim.

11.3 Exceptions

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages. In such jurisdictions, our liability is limited to the extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless State of Stride, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your user content

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

  • Deleting your account in the app or website settings
  • Contacting us at team@stateofstride.com

Upon termination, your data will be permanently deleted within 30 days.

13.2 Termination by Us

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or abusive behavior
  • Your account has been inactive for an extended period
  • Required by law or legal process

13.3 Effects of Termination

Upon termination:

  • Your access to the Services will cease immediately
  • Your data will be permanently deleted (unless retention is required by law)
  • You forfeit any unused subscription time (no refunds)
  • Sections of these Terms that by their nature should survive will continue to apply

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing a claim, you agree to contact us at team@stateofstride.com to attempt informal resolution. We'll work in good faith to resolve disputes.

14.3 Arbitration (U.S. Users)

Please read this section carefully—it affects your legal rights.

Any dispute arising from these Terms or the Services shall be resolved through binding arbitration, except:

  • Small claims court disputes (under $10,000)
  • Intellectual property disputes
  • Disputes that cannot be arbitrated by law

Arbitration Rules:

  • Arbitration will be conducted by the American Arbitration Association (AAA)
  • AAA Consumer Arbitration Rules apply
  • Arbitration will be held in Medford, Oregon or remotely
  • Each party pays their own costs and attorneys' fees

Class Action Waiver: You agree to resolve disputes individually. You waive the right to participate in class actions, class arbitrations, or representative actions.

14.4 International Users

If you are outside the United States, you agree to submit to the jurisdiction of the courts in Oregon for any disputes.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and State of Stride regarding the Services.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without your consent.

15.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control (natural disasters, pandemics, wars, labor disputes, etc.).

15.6 Notice

We may provide notices to you via:

  • Email to your registered email address
  • In-app notifications
  • Website announcements

You agree that electronic notices satisfy any legal requirement for written notice.
